Do I need council approval for a portable building or home?

Published RapidSiteplan

Whether you need council approval for a portable building or portable home depends on what it is used for and how it sits on the lot, far more than on the fact that it can be moved. A portable cabin used as a shed, a studio or an office is usually read like a shed, one that people sleep in is read like a dwelling, and one fixed to a slab or connected to sewer and water is treated as a building like any other.

Is a portable building treated like a shed?

Used for storage, a workshop or a home office with nobody sleeping in it, usually yes. It then takes the same tests as a shed: its floor area, its height, its distance to each boundary and the overlays over the lot. Small enough and far enough from the boundaries, a portable building can go ahead without council or building approval in most states when it meets every condition, and past those limits it needs approval like any shed. The shed and garage page covers the tests.

What if people sleep or live in it?

Then the council reads it as a dwelling. A cabin used as a bedroom, a portable home or a tiny home becomes a granny flat or a second dwelling in planning terms, with the floor area, the setbacks, the fire separation from the house and the services that go with one. A kitchen, a toilet or a sewer connection usually settles the question. The post on granny flat sizes covers what counts.

Does a cabin on wheels change it?

It can. A tiny home on a trailer that stays registered and can be towed away is often treated as a caravan, and councils set their own rules for living in a caravan on a lot, often for a limited time or for family. Take the wheels off, set it on piers and connect it, and it is read as a building again.

What about a shipping container?

A container is a portable building too, and the same split applies: storage reads like a shed, and a converted container someone lives in reads like a dwelling. Containers bring their own questions about how they look from the street. The post on shipping containers covers them.

Who decides?

The certifier or the council decides whether the building work needs approval, and the council decides the use, the zone and any overlay questions. The seller can tell you what the building is rated for, but the approval depends on your lot, so ask before the truck is booked.

Reading it for your own lot

RapidSiteplan reads the lot from its address in a minute: the boundaries, the house already standing, the mapped overlays and the services. Place the cabin at its true size and the sheet dimensions its distance to every boundary and to the house. The granny flat page shows the sheet for a cabin people live in, and the council pages for every state show what each council maps. Start with the address.

Common questions

Do I need council approval for a portable building or home? It depends on what the building is used for and how it sits on the lot, more than on the fact that it can be moved. A portable cabin used as a shed or a studio is usually read like a shed, one that people sleep in is read like a dwelling, and one on a slab or connected to sewer and water is treated as a building like any other.

Do I need council approval for a portable cabin in my backyard? For a cabin used as a studio, an office or storage, it takes the same tests as a shed: its size, its height, its distance to each boundary and the overlays over the lot.

Can I live in a portable cabin on my land? Only with the approval a dwelling needs. Sleeping, cooking or a sewer connection makes it a home in the council’s eyes, so it is read against the rules for a granny flat or a second dwelling, and a cabin on wheels can fall under the council’s rules for caravans instead.
