Do I need council approval for a patio in Queensland?

Published RapidSiteplan

Usually yes. In Queensland a roofed patio needs building approval in most cases, and a building certifier gives it, most often a private one rather than the council. The council steps in when the lot sits in an overlay its planning scheme maps, or when the patio would sit closer to a boundary than the siting rules allow. Answering the question means asking whether the patio needs building approval, whether the lot adds a planning question, and whether the patio clears every boundary.

What decides it for a patio?

Size and height come first. Small, low structures that meet every condition the state sets can go ahead as accepted development, which is Queensland’s name for building work that proceeds without a building approval, but a roofed patio of ordinary size is rarely one of them. Whether it fixes to the house or stands on its own posts matters next, because attachment changes how the patio is classified and what the certifier checks near the boundary.

The lot decides the rest: the distance from the patio edge to each boundary, the site cover once the new roof is counted, any easement in the way, and the sewer and water mains under the yard, which the water utility has to clear before footings go near them. Some councils also replace parts of the state’s siting rules with their own, often for small lots, so identical patios on different lots can get different answers.

Who gives the approval?

The building certifier assesses the patio and gives the building approval. You can choose the certifier yourself, or your builder or patio company can arrange it. Where the patio needs a siting variation, the council has to agree to it before the certifier can give the approval, and that request has its own fee and its own timeline. Where an overlay brings a planning approval, the council decides that as well, before the building approval. The post on council and certifiers explains how the planning and building approvals split.

What does the site plan have to show?

  • the boundaries with their lengths, and the house and sheds already on the lot
  • the patio at its real size with its posts, marked attached or freestanding
  • the distance from the patio edge to every boundary it faces, measured from the patio rather than the house wall
  • the site cover with the new roof counted in
  • easements and nearby mains, a north point and a scale

Reading it for your own lot

RapidSiteplan reads the lot from its address in a minute: the boundaries, the house and sheds traced from the aerial photo, the council, the overlays mapped over the block, and the easements and mains where they are published. Place the patio and the sheet dimensions its distance to every boundary, with the site cover total beside it as you move it. The patio and carport page shows what the sheet carries, and the Queensland council pages show how each council fits in. Start with the address.
