Can I enclose a patio or carport without council approval?

Published RapidSiteplan

Usually not once walls or glass go in, because enclosing a patio, carport or verandah changes what it is. With open sides it is an outdoor structure. Closed in, it starts to become a room, and a room is assessed on different terms: how close it sits to the boundary, how a wall that close stands up to fire, and whether the space gets the light and air a room needs. How far the enclosure goes decides the answer, and the certifier is the one who gives it.

Where does a patio stop being a patio?

Blinds that roll up and screens that let the weather through change the least. Fixed panels change more, and glass or solid walls on every open side change the most, because by then the space is used as part of the house. Each step moves the patio away from the rules for an open structure and towards the rules for a room, and the certifier reads where yours sits from the drawings.

The boundary is where it bites. An open patio close to a side or rear boundary is treated differently from a wall in the same place, so a patio that was fine open can need a fire-resisting wall, or more distance, once it is closed in. The post on boundary setbacks explains how that distance is measured.

A carport closed in with walls or a roller door raises the same question. How open a carport is decides whether it needs a fire-resisting wall near the boundary, and closing it in reopens that.

Who decides?

The certifier, or the council where it assesses building work, decides whether the enclosure needs building approval and assesses it if it does. If the lot sits in a character, heritage or flood overlay, the council may have a planning question first, since an enclosed room adds floor area the open patio did not. And if the patio itself went up without approval, the enclosure is when that comes out, so expect the certifier to deal with the patio as part of the job.

What goes on the site plan?

The plan shows the patio as it stands, with each side marked for what it becomes: screened, glazed or walled. It also needs the distance from each new wall to the boundary it faces, the house the patio fixes to, and the site cover. The certifier will usually want a floor plan and elevations of the enclosed room as well, and the site plan is the sheet that places it on the lot.

Reading it for your own lot

RapidSiteplan reads the lot from its address in a minute, with the boundaries, the house and anything else already built traced from the aerial photo, and the overlays mapped over the block. Place the patio at its size and the sheet dimensions its distance to every boundary, so you can see which sides sit close before anything is ordered. The patio and carport page shows the sheet, and the council pages for every state show what each council maps. Start with the address.
