What can I build without approval in Western Australia?

Published RapidSiteplan

In Western Australia some small work can be built without a building permit, and many outbuildings on a house lot can go ahead without development approval, both within the limits the state sets. Two approvals matter: development approval, which is the planning decision, and a building permit, which covers how the structure is built. A small shed or a low fence may be exempt from both, while a larger structure, or one on land with a heritage listing or an overlay, can need one or both.

Who decides in Western Australia?

The local government decides both. It gives development approval under its local planning scheme, and it is the permit authority that issues building permits. A private building surveyor can check the plans and sign a certificate that goes with a building permit application, which the local government then issues. The post on council approval explains how the pathways compare across Australia.

When can an outbuilding skip development approval?

When it meets the state’s residential design rules for its size, height and position, and the lot carries nothing that brings it back in. Those rules apply across the state, but a local planning scheme or a local policy can vary them, so the same shed can read differently in two areas. Where a structure departs from the design rules, the local government decides whether it can stay where you drew it.

What can bring approval back in?

  • a heritage listing, or a heritage area over the street
  • a bushfire prone designation or another overlay on the lot
  • a structure larger, taller or closer to a boundary than the design rules allow
  • an easement, or a sewer or drainage line, under the spot you chose

The post on planning overlays explains what each kind changes.

How do I check before I build?

Find the local government with the council finder, look up the zone, the density coding and every overlay on the lot, and compare your structure with the limits for its kind. Where it falls outside one, ask the local government or a building surveyor before you order materials. The bushfire prone check reads the designation from the address.

What may change: in October 2026 the state put a draft of its residential design rules out for comment, open until February 2027. The draft would take single houses, patios and carports out of development approval and drop the minimum car parking for a granny flat. Until the final rules take effect, today’s rules apply.

Reading it for your own lot

RapidSiteplan reads the council and building rules for your lot from its address, checks the design against them as you place it, lets you edit it as often as you like, and prints the site plan. Site plans and assessments in minutes. For a lot in Western Australia it shows the overlays and the boundary gaps that decide whether the work needs approval.

Search your address, or see what the plan shows for a shed, carport or other outbuilding. Council pages such as Armadale and Albany list what we hold, the Western Australia page lists every council in the state, and site plans by council covers the rest of Australia.

Common questions

What can I build without approval in Western Australia? Some minor work, such as a small garden shed, a low fence or a rainwater tank, may be exempt from a building permit within the limits the state sets. Many outbuildings on a house lot can also go ahead without development approval when they meet the state’s residential design rules and nothing on the lot says otherwise.

Can I build a shed without approval in Western Australia? A small one may be exempt from a building permit, and a larger one can often skip development approval when it meets the residential design rules. A heritage listing, an overlay or the local planning scheme can still call for approval.

What work is exempt in Western Australia? The state’s building rules list the minor work that needs no building permit, each kind with its own limits. The planning rules separately list the work that can go ahead without development approval, so read both for your lot.
