Building in Victoria Daly
Few local rules apply in Victoria Daly; the Territory sets most of them. Planning decisions sit with the Territory, whose consent authority decides development applications under the Territory-wide scheme. For the building side, talk to a registered building certifier early, since they issue the permit.
The hazard layers held for the Territory cover flood, heritage and native vegetation. The Territory's permit thresholds for small sheds and shade structures are tight, so confirm with a certifier before ordering a kit. The Territory has exhibited a change to the low-density residential zone that would allow more infill and subdivision. Applications for the area are advertised on the Territory's planning notices site.
What we hold for Victoria Daly
For Victoria Daly we hold the council’s own rules for:
- sheds, garden sheds, garages and carports
- patios, pergolas, louvred roofs, decks and shade sails
- pools, fences and retaining walls
- granny flats
- driveways, water tanks and shipping containers
At each lot we check the state’s mapping for flood, heritage and native vegetation. We also read the council’s application register for past applications on the lot.

How approval works in the Northern Territory
In the Northern Territory building permits come from private building certifiers registered with the territory, not from the councils, and some minor building work is exempt from a permit. Planning is run by the territory too: the Development Consent Authority decides development applications, and many houses and outbuildings in residential zones need no development permit when they meet the planning scheme's requirements. The certifier reads the site plan for where the structure sits against each boundary and the house. The zone and the scheme's siting requirements decide whether a development permit is needed, as per the NT Planning Scheme 2020 and the Building Act 1993.
Drawing the plan
Type the property address, trace the block over the aerial view, since the territory publishes no boundary layer to load, and place the structure. The plan prints to scale with boundary lengths, setback distances, a north arrow, a legend, a site coverage table and a title block, as the site plan for a building permit or a development permit.
What a certifier in Victoria Daly will ask you
How big can a granny flat be, and how far from the house?
The council caps a granny flat’s floor area, and some councils also limit how far from the house it may stand. The sheet prints the floor area and dimensions the distance to the house.
How deep is the pool?
The depth decides whether the water needs a barrier, and the barrier has to be in place before the pool is filled. The barrier is what gets inspected, so the sheet shows where it runs and every gate with its swing.
Is the lot in an overlay, and what is the zoning?
A flood, bushfire, heritage or character overlay can bring a planning approval on top of the building approval, and the zone decides which of the council’s rules apply. The mapped overlays are read at the lot as the structure goes on the plan.
Is the patio a pergola, a louvred roof or a solid roof?
An open pergola and a roofed patio are treated differently near the boundary, and louvres that shut to shed water count as a roof. Roofed, it also adds to the site cover total on the sheet.
The figures for your own lot are read in a minute, from its address.
Every question a certifier asks is on the the Northern Territory page.
