Can I build a granny flat in a flood zone?

Published RapidSiteplan

Often you can, but the flood overlay decides how. A granny flat is a home, so its bedrooms and living areas count as habitable rooms, and in a mapped flood area the council sets the level their floor has to sit above. On some lots that means a raised floor on piers, on others a higher slab, and on the worst affected land the council may not support a new home at all.

What does a flood overlay change for a granny flat?

  • the floor level of every habitable room, set above the council’s flood level with a margin
  • whether the council needs a planning application before the building approval
  • the materials and fittings below the flood level, which have to cope with water
  • where on the lot it can sit, since the low part of a lot often floods first
  • the structure, which may need an engineer to design it for flood water

The post on flood overlays explains how the maps are drawn and what each part of an overlay means.

Who sets the floor level?

The council. It publishes the flood level for the lot, usually through a flood search or flood check on its website, and its planning scheme says how far above it a habitable floor must sit. The certifier or building surveyor then checks the design against that level before approving the building work. A sheet showing the natural ground across the lot helps, because the height of the floor above the ground is what the builder works to.

Is a granny flat treated differently to a shed?

Yes. A shed or carport is not habitable, so many councils let it sit lower than a home, often with a lighter set of conditions. A granny flat gets the same flood rules as a house, and sometimes stricter ones, because it adds people to the lot.

Can I still build if the lot is deep in the overlay?

It depends on the council and the flood’s depth and speed on your lot. Some councils limit new homes where the water would be deep or fast, or ask for a flood report from an engineer. Ask the council early, before the design is drawn, and read the flood overlay check for your address.

Flood maps change. In October 2026 Logan City Council endorsed new flood mapping that would take many properties out of its flood overlay; it waits for the state’s approval, expected in early 2027. Until a new map takes effect the current one applies, so check it again before you lodge.

Reading it for your own lot

RapidSiteplan reads the council and building rules for your lot from its address, checks the design against them as you place it, lets you edit it as often as you like, and prints the site plan. Site plans and assessments in minutes. On a lot in a flood overlay the plan shows the overlay and the ground levels, so you see where the granny flat sits against the flood before it is drawn in detail.

Search your address, see what the plan shows for a granny flat, or open a council page such as Logan or Ipswich. Site plans by council covers the rest of Australia.

Common questions

Can I build a granny flat in a flood zone? Often yes, as long as its floor sits above the level the council sets for the lot and it is built to resist the flood. Where the flood is deep or fast, some councils limit new homes or ask for a planning application first.

What does a granny flat flood overlay change? It sets how high the floor must sit, can bring a planning application on top of the building approval, and decides what the parts below the flood level are built from. The overlay code for your council says which apply.

Who sets the floor level of a granny flat? The council sets the flood level and the margin above it for habitable rooms, and the certifier or building surveyor checks the design against it. A surveyor measures the ground so the plan shows the real heights.
